Terms of Service

By accessing or using Niora ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Niora.

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

Niora is a wellness companion app that provides:

• •Personalized meal plans and nutrition tracking
• •Custom workout programs and exercise guidance
• •Intermittent fasting tracking and support
• •Health insights and progress tracking
• •Integration with Apple Health and Apple Watch
• •Optional connection with wellness coaches (Partner Program)

We continuously improve our services and may add, modify, or discontinue features at any time. We'll notify you of significant changes that affect your use of the App.

To use Niora, you must create an account. You agree to:

• •Provide accurate and complete information when registering
• •Keep your login credentials secure and confidential
• •Notify us immediately of any unauthorized access to your account
• •Be responsible for all activity that occurs under your account
• •Be at least 16 years old to create an account

You may delete your account at any time through the App settings (Settings → Account → Delete Account). Upon deletion, your personal data will be immediately removed from our servers. You may also request an export of your data before deletion (Settings → Account → Export My Data).

You acknowledge and agree that:

• •Niora does not provide medical advice. Always consult with qualified healthcare professionals before starting any diet, exercise program, or fasting regimen.
• •If you have any medical conditions, take medications, are pregnant, or have concerns about your health, seek professional medical advice before using our services.
• •AI-generated meal plans and workout recommendations are suggestions based on general guidelines and your stated preferences—they are not personalized medical prescriptions.
• •You are solely responsible for your health decisions. Stop any activity immediately if you experience pain, discomfort, or adverse symptoms.
• •In case of emergency, contact emergency services immediately—do not rely on the App.

Niora offers both free and premium subscription options. For paid subscriptions:

• •Subscriptions are billed through Apple's App Store. Payment terms are governed by Apple's terms of service.
• •Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• •You can manage or cancel your subscription through your Apple ID account settings.
• •Refunds are handled by Apple according to their refund policies.
• •We may change subscription prices with reasonable notice. Price changes won't affect your current billing period.

You agree not to:

• •Use the App for any illegal purpose or in violation of any laws
• •Attempt to gain unauthorized access to our systems or other users' accounts
• •Interfere with or disrupt the App's functionality or servers
• •Reverse engineer, decompile, or attempt to extract the source code
• •Use automated systems (bots, scrapers) to access the App
• •Share your account credentials with others or create multiple accounts
• •Upload malicious content, viruses, or harmful code
• •Harass, abuse, or harm other users or our staff
• •Impersonate any person or entity
• •Use the App to promote competing products or services

Violation of these rules may result in immediate termination of your account.

You may submit content to Niora, including meal photos, workout notes, feedback, and feature requests. By submitting content, you:

• •Retain ownership of your content, but grant us a license to use it for providing and improving our services
• •Confirm that you have the right to submit the content and that it doesn't violate anyone else's rights
• •Understand that meal photos and other content may be analyzed by third-party AI services (including Anthropic and Google) to provide nutrition information, recommendations, and insights
• •Acknowledge that feedback and feature requests may be used to improve the App for all users

We reserve the right to remove content that violates these terms or is otherwise objectionable.

We do not guarantee that:

• •The App will be uninterrupted, error-free, or completely secure
• •Results from using the App will meet your expectations
• •AI-generated recommendations will be accurate or suitable for you
• •Data synced from Apple Health will always be complete or accurate

Limitation of Liability: To the maximum extent permitted by law, Niora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the App.

You may terminate your account at any time by deleting it through the App settings or by contacting us.

We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if we discontinue the service. We'll provide notice when possible, except in cases of serious violations.

Upon termination, your right to use the App ceases immediately. Provisions that should survive termination (such as disclaimers, limitations of liability, and dispute resolution) will remain in effect.

We may update these Terms of Service from time to time. When we make significant changes, we'll notify you through the App or via email.

Your continued use of the App after changes take effect constitutes acceptance of the new terms. If you don't agree with the changes, you should stop using the App and delete your account.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of the App shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts.
